Couple Was Heard Arguing Before Fatal Crash

Gilbert Gil, 31, of Milpitas was arraigned in court Monday.

The Milpitas couple involved in a fatal crash in Fremont last Tuesday was heard arguing just before their Honda drove into a tree, killing the mother and their 3-year-old son, according to media reports. 

Court documents read during the Monday arraignment of Gilbert Gil, the 31-year-old father, included a statement from a bicyclist who told police that he heard what “sounded like a male and female arguing” coming from the car, SFGate reports.

Gilbert Gil is believed to have been driving at least 67 mph in a 35 mph residential zone while en route to a local waterpark, according to SFGate.

He was driving his wife Joie Gil, 31, and 3-year-old son Angelo Gil at around 12:50 p.m. on Paseo Padre Parkway between Chadbourne Drive and Dorne Place, when he lost control of the vehicle, according to police. The car split in half when it careened into a tree.

Gilbert Gil and his child, who was fastened in a child safety seat in the backseat of the car, were ejected from the vehicle, police said.

Angelo Gil was pronounced dead at the scene. Joie Gil was pulled from the vehicle but was pronounced dead Wednesday, according to police.

Gilbert Gil suffered major injuries and underwent surgery the night of the accident. He was arrested Friday.

On Monday, Gilbert Gil was charged by Alameda County prosecutors with two felony counts of vehicular manslaughter with gross negligence and one count of felony child endangerment.

According to online court records, Gilbert Gil is being held in the infirmary at Santa Rita Jail on $350,000 bail.

The Fremont Argus reports that Gilbert Gil appeared in court Monday with bandages covering his elbows. He held his head down as the judge read him his charges.

Gilbert Gil is scheduled to return to court Tuesday to be assigned a public defender, according to the Argus.
